Judicial practice on the issue of reducing the penalty under article 333 of the Civil Code of the Russian Federation

The article examines the Russian law enforcement practice on the issue of reducing the penalty under Article 333 of the Civil Code of the Russian Federation. Both clarifications of the Constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation and the practice of lower arbitration courts are considered. The article analyses the grounds for reduction, to which situations Article 333 of the Civil Code of the Russian Federation applies and does not apply, and what constitutes a legitimate reduction of the penalty.
