Judicial protection of the rights of orphans and children left without parental care

The article is devoted to the judicial protection of the rights of orphans and children left without parental care in the sphere of housing legal relations. The relevance of the chosen topic is explained by the importance of the proper exercise of the right to receive housing for orphans and children left without parental care, for a state that proclaims itself as a welfare state. The author analyzes the existing legal mechanisms for the protection of housing rights when considering cases of this category by the court. Their analysis allowed us to conclude that there is legislative protection of the rights of orphans and children left without parental care, but there are systemic problems in the implementation of this right. The author of the article suggests the exclusion of the age limit for submitting an application for inclusion in the list of orphans and children left without parental care who are subject to housing provision, consider allocating a housing certificate to orphans with assistance in acquiring housing under it.
