Judgment in civil proceedings: concept and problems

One of the court documents issued by the Magistrate's Court is a court order. It is mentioned in Art. 121 Code of Civil Procedure of the Russian Federation. In the article, we examined what requirements interested persons can apply to the court for their adoption. We also revealed the advantages of writ proceedings (consideration of the case in a short time, reduction in court costs of participants in the process, reduction in the costs of the judicial apparatus for sending mail and time for such sending) and its main disadvantages (incorrectness of Article 122 of the Code of Civil Procedure of the Russian Federation, the problem of collecting court costs , the problem of the return of funds withheld by the bailiff under a court order, and others). These problematic aspects, as we considered, are the most global in writ proceedings and require their resolution in the first place, in connection with which we have given possible options for their resolution.
