Judicial and court procedure guarantees of independence of the judiciary and judges

The division of principles into judicial and court ones is quite conventional, like any classification. The content of the principles and the guarantees of their implementation are manifested both in the organization of the judiciary and in the procedural rules regulating the activities of the court. The principle of independence of the judiciary, the judicial system and judges has a deep and voluminous content and its manifestation. The purpose of this article is to show in general terms the judicial and court guarantees of this principle, the freedom of the judiciary and judges from external and internal influence, as well as the importance of the psychological aspect of this principle. Based on the analysis of the content of the principle of independence of the judiciary and judges, we can come to the conclusion that the guarantees of independence of the judiciary from external influence are largely judicial in nature, while the independence of judges from external and internal influence is of a court (judicial-procedural) nature, regulated by procedural codes (laws).
