Surrogate maternity in Russia: analysis of legislation and practice

The article covers the experience of legal regulations of surrogate maternity in the Russian Federation. It reveals statements of main legal and regulatory acts, which administer realization of the surrogate maternity program, studies some problems connected to implementation of the stated legal norms in practice. The article uncovers the contents of such categories as “surrogate maternity”, “surrogate mother” in details and distinguishes their attributes and characteristic features. Special attention is paid to the study of the subject contents of legal relations, which appear in connection to realization of the surrogate maternity program. Herewith, it analyzes some collisions of legislation in power, which regulates the procedure of registration of genetic parents of a child born to a surrogate mother in the register of births. The article researches some problems of a contract between a surrogate mother and genetic parents (one parent). It gives statistic data and materials of judicial practice.
