The essence of the "rule of law" principle and the criteria for its testing in the practice of higher courts

The article substantiates the importance of the constitutional principle of the rule of law in judicial practice from the standpoint of its content in the concepts of «rule of law», «supremacy of the Constitution» and «rule of law». The authors, based on the practice of the Constitutional Court of the Republic of Azerbaijan and the European Court of Human Rights, note the peculiarities of the criterion for assessing the principle of the «rule of law» in the decisions of higher courts.
