The article examines the constitution as one of the components of the social self-organization of society. It is concluded that the phenomenon of constitutionalism is not an invention of Modern times, but the primordial organizational foundations that are inherently formed along with the formation of society and the improvement of the language, going back centuries, taking different forms in the course of its development. The Constitution is interpreted as a social phenomenon that existed long before the term itself was coined. The essence of the constitution is subordinated to its social function - overcoming obstacles to social development through general ideas about the principles of social being. It is a purposefully improved systemic legal regulator of public relations, preventing the regression of sociality. Unconstitutional societies do not exist and have never existed. The article reflects the author's formed position on the constitution as a social phenomenon, which is only one possible position in science and does not claim to be exclusive.
