The social value of criminal proceedings lies in its ability to provide both the interests of the whole society, and the rights, freedoms, legitimate interests of every person and citizen. This manifesto draws its promises in international legal acts, the constitutions of many countries, including the Russian one, and is reflected in the most central article of the Code of Criminal Procedure (hereinafter - the Criminal Procedure Code) of the named "Appointment of Criminal Proceedings". The need to protect social values led to the formation of criminal proceedings based on the principle of adversarial nature of the parties and the leading function of the court to establish the circumstances that are included in the subject of proof. Therefore, the most important mechanism of cognition of such circumstances is proving - gathering, checking and evaluation of evidence. In connection with this, the correct evaluation of evidence is the final result of the adoption of lawful, justified and fair procedural decisions in the investigated and considered criminal case.
