Customs protection of rights intellectual property in the European Union

This article discusses issues related to the legal regulation of customs and legal protection of intellectual property rights in the European Union. The article also examines both the law of the union (located in the Customs Code of the Eurasian Economic Union and in the agreement on the functioning of the union) formulates the rules regarding the restrictions and prohibitions on the import, transit and export of goods in order to protect intellectual property rights, as well as other procedural rules that govern measures for goods that violate intellectual property rights. This procedure for measures taken is codified in the Regulations of the European Parliament, as well as in the Council of the EU. This article discusses some aspects of this Regulation, in particular, examples from the practice of the EU court regarding the protection of intellectual property rights, the competence of EU institutions in the field of customs and legal protection of intellectual property rights. Customs control measures are disclosed for goods suspected of infringing intellectual property rights.
