Theoretical model for constructing a system of crimes resulting in the spread of defamatory fabrications

The paper attempts to build a scientific and practical model for improving the provisions of criminal law governing liability for crimes expressed in the dissemination of defamatory fabrications. The author proposes to abandon the phrase “knowingly false information”, replacing it with a more capacious and accurate term, such as “fabrication”. The basis for the construction of such a system is determined, as well as the characteristics (criteria) by which it should be characterized. Recommendations have been developed to optimize the legislative description of existing crimes. Proposals are made to supplement the Criminal Code with new acts, in particular, slander against senior state officials, a candidate for elected office, and a legal entity. Moreover, a practical model of the system of attacks, expressed in the spread of defamatory fabrications, is proposed.
