Theoretical and practical aspects of forming the legal basis of environmental protection as a joint jurisdiction of the Russian Federation and its constituent entities

Based on the analysis of Art. 72 of the Constitution of the Russian Federation on the subjects of joint jurisdiction of the Russian Federation and its constituent entities, a scientific substantiation of the concept of a two-level system of environmental legislation is proposed. It is proved that the task of this concept is the formation in the regional legislation of a systemic legal regulation of environmental protection as an independent level in the structure of Russian environmental law. An analysis of the laws of the constituent entities of the Russian Federation on environmental protection made it possible to show gaps and systemic defects in legal regulation at the level of the constituent entities of the Russian Federation. It is proved that the environmental rights and obligations of citizens are subject to consolidation, taking into account the need to ensure the original habitat and traditional way of life of ethnic communities.
