The article is devoted to the consideration of theoretical foundations of the differentiation of criminal liability for illegal acquisition, storage, transportation, manufacture, and processing of drugs. Special attention is focused on three key elements: the historical background of the differentiation of criminal liability, its concept and essence, and function. The author formulates the approach to understanding the differentiation of criminal liability as a systemic legal mechanism aimed at implementing the principles of justice, efficiency and humanization of criminal law. The importance of the process of differentiating criminal liability for drug crimes, ensuring a balance between the public danger of drug crime and the punishment imposed is highlighted.
