The theoretical-legal aspects of the managerial mechanism of migration processes: specificity and status

The article discusses the current issues, which are related to the management organization in the migration sphere, which is depending on the coordination activity effectiveness of all state regulation system in this sphere. In the present period of globalization trend and the global economic crisis consequences the growing extent of natural-climatic threats and technogenic disasters are leading to the uncontrolled processes (latent) migration activation, which are also has a negative impact not only on the migration sphere status, but even it threatens the migration security. In general, the current migration circumstance is underlined the necessary to focus attention on developing and improving the system of measures to ensure law and legal order in the migration sphere of the society, which is manifested in the quality of legal regulation (lawmaking and law enforcement) of these relations. The provision of quality legal regulation, carried out by regulating the rights and responsibilities of migration relations partici- pants, cannot be implemented without awareness of the necessary for the formation of appropriate coherent legal mechanism under current settings. Therefore, the normal migration sphere functioning, its social role and functionality will be possible if there are indentified all legal (and non-legal) instruments of the social administration, as well as a working and viable mecha- nism of law-creation and law enforcement is established at all levels of social engineering. In this connection, one of the urgent tasks is the legal framework improvement of the migration sphere functioning of the society, with regard to its protect ability, which is implying instruments, methods and modes enhancement, regulating its performance to enhance the vitality of the whole society. Recognizing the most important role of remedies in the legal regu- lation of migration relations, one cannot ignore the role of one which is carrying such influence by both the normative and non-normative possibilities. Besides, the article examines the factors, which are influencing on the migration sphere managerial function implementation; that implementation is carried out in the absence of a single coordinating authority in the country. It is also a mechanism is proposed to improve the organization framework for the migration processes regulation in the managerial system of the Russian Federation
