Transformation of the legal aspects of the use of digital technologies in the field of corporate procurement

The article discusses the process of transformation of the legal aspects of the use of digital technologies in the field of procurement carried out in accordance with the requirements of the Federal Law “On Procurement of Goods, Works, services by certain Types of Legal Entities” dated 18.07.2011 № 223-FZ. The author notes the importance for business of using modern IT technologies both from the point of view of the economic component and in order to comply with the transparency of procurement procedures. The analysis of scientific literature and regulatory legal acts allowed us to identify a number of changes that contribute to the promotion of digital transformation in the field of corporate and public procurement. In addition, the author concludes that limiting the number of electronic bidding platforms on which participants can place their proposals and exercise their rights and obligations related to procurement helps to speed up the search process for suppliers and increase the transparency of procurement procedures. The sphere of influence of the state on the activities of small and medium-sized businesses also did not remain without attention, since it was in this direction that the legislator tightened the rules for conducting competitive procedures and obliged customers to conclude contracts in electronic form using all possible automation tools provided by selected electronic platforms. This makes it possible to exclude the possibility of forgery or distortion of information and to ensure the openness and objectivity of the procurement process, including avoiding collisions with the late provision of a signed contract by the supplier. At the same time, the author concludes that modern information technologies make it possible not only to announce purchases and conclude contracts, but also to carry out electronic acceptance of delivered goods, completed works, services rendered and ensure control over the fulfillment of contractual obligations. The introduction of appropriate amendments to 223-FZ will contribute to the transition of contractual relations in electronic form, which in turn will facilitate the implementation of supervision by state bodies.
