The requirement to provide access to the public land

The author analyzes the norms of legislation concerning the provision of a land plot with access to public lands. He criticizes the provisions on the urgent and contractual nature of the servitude, on providing access through a zone with special conditions of use. He comes to the conclusion that the existing legislation does not allow ensuring the guarantees of the rights of the owner of such land plots, as well as the need to consolidate this requirement in Article 11.9 of the Land Code of the Russian Federation. It proposes to introduce into Article 262 of the Civil Code of the Russian Federation a definition of the concept of «general use land».
