The article analyzes the employment contract as a variety of all-legal structure of the contract. It’s presumed that the characteristics of the employment contract as the legal construction due to the goals of the labor legislation (the establishment of state guarantees of labor rights and freedoms of citizens, creating favorable working conditions, protection of the rights and interests of workers and employers), its tasks (creating the necessary legal conditions for optimal coordination of interests sides of the employment relationship, the interests of the state) and the principles of legal regulation of labor relations and other relations directly linked to them. We prove that the violation of the internal unity of the elements that make up the labor contract system and its connections can lead to conflicts and other defects in the labor law. As an example, the conflict between the provisions of Articles 72.1 and 74 of the Labor Code. The lack of internal consistency legal construction of the employment contract can be traced to the norms that establish specific labor regulations of certain categories of workers who are formally contradict the rule that the additional terms of the employment contract may not impair the employee's position in comparison with the established labor laws. Accordingly, the conclusions are made about the need to bring in the logical consistency of such design elements of the employment contract, as the translation and changes in the conditions of the employment contract, and to clarify rules banning worsen the situation of the worker as compared with the labor legislation (Part 2 of Art. 9 and Part 4 of Art. 57 of the Labour Code). Stated the problem of constructing such a legal structure that would meet the requirements of the rules of logic and the legislative machinery. Sectoral legal structure must fit into the structure of the industry, to have a single value for the legal acts regulating a particular kind of public relations. The article notes the invaluable contribution L.Yu. Bugrova in the development of the theory of the employment contract.
