Training time in the internal affairs of the Russian Federation: problems of law enforcement

The author carried out a comprehensive analysis of the norms of labor, administrative and service law in terms of accounting for service time and rest time of employees of the internal affairs bodies and the problems that arise in their application. The classification of types of service time depending on the duration is given: normal, reduced and incomplete. In the official activities of employees of the internal affairs bodies, several legal regimes are distinguished: working time, working week, days off, working day. According to the author, the organization of work on accounting in the internal affairs bodies of working time and rest time consists of three stages: preliminary, main and final, each of which is carried out by authorized employees. The author singled out the main guarantees for employees of the internal affairs bodies when they are called to service in excess of the established normal length of service time, as well as at night, on weekends and non-working holidays.In conclusion of the study, proposals were made to improve service legislation to bring it into line with labor legislation and more detailed regulation of the procedure for attracting employees of internal affairs bodies to perform official duties in excess of the normal length of service time established for them and accounting for such time in order to prevent violation of their rights in part providing appropriate compensation.
