Criminal legal support of inclusions of the criminal offense to the Criminal Code of the Russian Federation

Introduction: the authors analyze the criminal provisions of the draft of Federal Law "On Amendments to the Criminal Code of the Russian Federation and the Code of Criminal Procedure of the Russian Federation in connection with the introduction of the notion of criminal misconduct", approved by the resolution of the Plenum of the Supreme Court of the Russian Federation on October 31, 2017. Materials and Methods: the study is based on dialectical-materialistic, logical, historical, system and structural and comparative-legal methods. Results: the gaps in the bill dreafetd by the Supreme Court of the Russian Federation are revealed. Based on the analysis of its text, scientifically based theoretical conclusions are formulated. The author's definition of the concept of a criminal offense is given, its criminal legal significance is determined in the context of the development of modern criminal and legal policy, conclusions are drawn about the history of development of this category in the domestic criminal law, the experience of foreign states. Discussion and Conclusions: as proposals for amending and supplementing the provisions of the draft law, practical recommendations are being developed to improve criminal legislation of Russia.
