Criminal law element of the institute of administrative supervision

The article is devoted to the study of legal nature of the institute of administrative supervision. The author substantiates the conclusion that the administrative supervision of persons released from prison is in the modern version a comprehensive inter-sectoral institution, including criminal law, criminal executive and administrative elements. The criminal law component (element) of this legal sanction is determined by the fact that administrative supervision has a criminal law basis (criminal record) and acts as a means of ensuring criminal legal sanction on persons released from prisons. In author's opinion administrative supervision is of proactive character taking into account its goals and objectives, its nature and social purpose. The author substantiates that changing the name of the given type of supervision allows revealing its specific and complex nature in full measure.
