Criminal law compromise in countering drug crimes

The article discusses compromise criminal law norms applied in countering crimes in the field of illicit trafficking in narcotic drugs and psychotropic substances. The general and special grounds for exemption from criminal liability for drug crimes are analyzed, in particular in connection with active repentance (Article 75 of the Criminal Code of the Russian Federation), with the imposition of a court fine (Article 76.2 of the Criminal Code of the Russian Federation), as well as in accordance with the notes to Articles 228, 228.3 of the Criminal Code of the Russian Federation. The trends and problems of the implementation of such a type of exemption from criminal punishment as a postponement from the execution of punishment for drug addicts are investigated. The generalization of practice by the Supreme Court of the Russian Federation is analyzed, examples of judicial practice are given, and proposals are formulated aimed at improving the legal nature of the norms under consideration and law enforcement practice.
