The human resources management as a new type of legal activities (case study of Russia and Japan)

The article carries out a comparative analysis of Russian and Japanese legislation in the field of human resources management in the framework of the instrumental theory of law. The research results have identified the main legal means capable of changing motivation of employees and increasing of labor productivity. The author considers constitutional theses and particular laws covering the labor relations, features of the labor contract, social security, working conditions, and personnel training in both countries. The Harzburg model of management is described. The paper also compares Japanese HR management system with the European and the American ones.
