Conditional deposition (escrow) as a way to ensure the fulfillment of obligations in the sphere of remote retail sale

In this article, the author analyzes escrow as a way of enforcing obligations in the field of distance retail sale. The article concludes that the escrow agreement is a new stage in the development of the Russian settlement system, which can be widely used in transactions governed by Russian civil law. The legal structure of the deposit is designed to ensure the interests of the parties in the performance of obligations, which is achieved through the participation of an independent third party in the transaction execution process - an escrow agent. In the field of remote retail sale and purchase relations, escrow is used as a security for the fulfillment of obligations, but it is not regulated by law in any way, therefore, the stores on the Internet themselves actually use a similar protection mechanism, and call their services “services of secure transactions”, “secure transactions ". It seems that the legislative consolidation of the universal (general) design of the escrow agreement is mandatory.
