The discretion of the court in the appointment of criminal punishment

The article is devoted to the poorly studied problem of principles and limits of judicial discretion in prescribing the type and measure of criminal punishment by the court. Absence of statutory doctrine of judicial discretion per se, as well as of concrete theoretical solutions in respect of its application, and also the closed character of mental and professional training of discretion among the practitioners.
