The article analyzes the relationship between the theory of utilitarianism and the harm principle of John Stuart Mill in the context of his views on state and law. It is concluded that the principle of individual freedom can define the limits of state interference in social relations by legal regulation. The author analyzes the legislatively established measures of administrative and criminal liability taking the harm principle into account.
