Victimological characteristics of crimes related to the violation of copyright and related rights

In the article, the author describes the victim of a crime related to plagiarism-considers the categories of victims, their rights that may be violated and the reasons for their victimization. The concepts of “copyright”, “victimization” are revealed, a brief description of the subjects of copyright and their rights is given. The article analyzes statistics on the state of crime in the period from 2010 to 2020, as well as data from various state and non-state organizations related to copyright infringement, including the costs incurred by copyright holders in connection with the distribution of illegal content. In addition, foreign statistics on copyright infringement, regulatory legal acts and local acts of organizations related to copyright are provided. The article notes that in addition to the gaps in the legislation, the key factor of copyright infringement is the human factor - the authors ‘ ignorance of the full range of copyrights, the mechanisms of their protection and protection; the “pirates’s” ignorance of the illegality of their actions; the reluctance of law enforcement officers to register crimes. As a result of the research, the author offers recommendations for reducing the number of crimes qualified under the provisions of Article 146 of the Criminal Code of the Russian Federation, as well as recommendations for reducing the level of victimization of victims.
