Guilt in tort obligations: legislation, theory, practice

The article examines the features of guilt as a condition of civil liability for harm, analyzes the reflection of this category in modern legislation and judicial practice, and conducts a retrospective analysis of its definition at the legislative and doctrinal level. The absence of a systematic approach to the definition of guilt and its forms in domestic legislation generates the unpredictability of legal regulation, which is most clearly manifested in the process of law enforcement. The author concludes that the issues of guilt and related categories need legal certainty, which would ensure uniformity and the possibility of achieving a balance between humanity and justice in resolving disputes on compensation for harm.
