The impact of sanctions regimes on electricity generation in Russia: legal aspects

Бесплатный доступ

Russian electric power generating companies found themselves in a sector of the economy prohibited by the European Union - electricity generation in Russia, which led to unjustified refusal of European individuals and legal entities, as well as Russian companies under their control, to fulfill contracts with Russian power generating companies for the supply of power equipment and spare parts, refusal to perform maintenance of power generation facilities and withdrawal from business in Russia. The state has developed a number of support measures in the electric power sector. However, the current economic situation has exposed a number of legal problems: the need to protect the energy sovereignty of the Russian Federation and protect the energy business from technological aggression; the inoperability of corporate management bodies consisting of foreigners; the difficulty of applying anti-seeking ban under Article 248.1 of the RF Civil Code; new application of the norm of Article 1193 of the RF Civil Code to protect the public order of the Russian Federation.
