The article is devoted to the study of the origin of the institution of legal responsibility of the state. The ideas of ancient philosophers about a state having certain obligations to citizens and about the need to limit power by law are considered. The corresponding sayings are presented and analyzed, various positions and opinions contained in the works of philosophers are demonstrated. The features of the occurrence and the circumstances, the occurrence of which entails the responsibility of the state before the members of society. The possibility of legal restrictions on state interference in private matters is analyzed.
