Questions of the fairness of the establishment of confiscation of property and a court fine in the Criminal Code of the Russian Federation

Through the criteria of fairness, gaps and contradictions of the current criminal law norms on confiscation of property and a court fine are considered. When confiscating property, first of all, the issues of compensation for harm to the victim and the rightful owner should be fairly resolved. When exonerating from criminal liability with the imposition of a judicial fine, fair (proportionate) compensation for harm to the state should be of decisive importance. Based on the analysis of the norms of the Criminal Code of the Russian Federation and judicial practice, the possibilities of fair improvement of the criminal law and the practice of its application are deduced.
