Matters of criminal legal qualification of actions of law enforcement officers of operational units allowing provocation according to article 304 of the Criminal Code of the Russian Federation

Introduction: in the article, matters of criminal legal qualification of actions of law enforcement officers of operational units allowing provocation according to article 304 of the Criminal Code of the Russian Federation are considered on the basis of the analysis of operational-search, investigative and judicial practices. Materials and methods: the regulatory framework of the study is formed by operational-search and criminal law, which prohibits provocation as part of the implementation of operational-search activity and criminalizes it according to article 304 of the Criminal Code of the Russian Federation. The methodological basis of the study was the general dialectical method of scientific knowledge that has a universal character, as well as methods of logical deduction, induction, cognitive methods and techniques of observation, comparison, analysis, synthesis and description.
