On the Internal Structure and Systematisation of Criminal Legislation

The article raises questions of the internal structure and systematisation of modern Russian criminal legislation, its structural elements, which are interdependent and interacting subsystems of the internal order. The attention is also paid to the study of systemic problems related to the construction of criminal law and the clarification of its internal composition and structuring, which today represents an urgent scientific discussion that demands its resolution and causes active debate among legal scholars and practicing lawyers. Based on the research, the conclusion is formulated that new criminal law provisions are often inconsistent with those already in force; they also conflict with them, and have legal and technical imperfections, negatively affect their practical implementation. In order to increase the effectiveness of the current criminal law, it is proposed to supplement its system with new systemic and structural elements, which are the institutions of criminal misconduct and criminal liability of legal entities, which is generally aimed at differentiating and individualising criminal liability and punishment.
