The article analyzes issues related to the rehabilitation of persons with the status of entrepreneurs who have been unlawfully convicted. Using examples from judicial practice, the author shows how the compensatory mechanism for restoring the rights of both entrepreneurs and other persons is implemented. Analyzes the criteria for determining compensation for moral damage to persons unlawfully subjected to criminal prosecution by the courts. Concludes that it is necessary to strengthen the measures of state responsibility for restoring the rights of entrepreneurs in the event of their unjustified prosecution.
