Compensation for damage caused by illegal actions (inaction) of employees of the internal affairs bodies: conditions and specifics of responsibility

This article reveals the main features of liability for damage caused by illegal actions (inaction) of employees of internal affairs bodies. The regulatory framework of the designated legal institution is highlighted. The procedure and conditions for compensation for damage caused by illegal actions (inaction) of employees of internal affairs bodies have been determined. The analysis of general and special legislation on civil liability for harm caused by illegal actions (inaction) by employees of internal affairs bodies was carried out, and based on the analysis of judicial practice, typical situations of illegal actions (inaction) by employees of internal affairs bodies that caused harm to citizens (commission of a disciplinary offense, administrative offense, criminal offense) were identified, and also the procedure of recourse claims of the Russian Federation in the person of the Ministry of Internal Affairs of Russia to employees who caused such harm is defined. A scientific analysis of the regulations on compensation for damage caused by illegal actions (inaction) of employees of the internal affairs bodies allowed us to identify some legislative conflicts, first of all, the identified terminological discrepancies in the general and special norms on the legal institution under study. For example, the similarity of the concepts of "illegal" and "illegal" in the general and special norms on compensation for damage caused by illegal actions (inaction) of employees of internal affairs bodies, obviously having etymological differences, requires legislative unification. The authors propose to bring to uniformity the conceptual apparatus of the legal category analyzed in the article for their effective enforcement.
