Temporary protection of an industrial design: issues of legal regulation

The article discusses the need to introduce the Institute of temporary protection of an industrial design, as well as the essence of this legal regime. The article analyzes the concept of an unregistered industrial design that operates within the European Union. The article reveals shortcomings related to the legal protection of industrial designs under several legal regimes simultaneously-patent, copyright, and trademark rights. Foreign experience of overcoming this conflict is being studied.
