Departure abroad of citizens of the Russian Federation: rules of departure and current problems

The article identifies and analyzes legal problems that regulate issues related to the departure of minors from the Russian Federation. The authors believe that the right of a parent indefinitely, arbitrarily, and in fact categorically restrict the child's travel abroad on the basis of one only of his will without notice and without consulting the other parent is a violation of part 2 of article 27 of the RF Constitution, item 1, 2 article. 65 of the Family code of the Russian Federation and abuse of parental rights, an action to the detriment of the interests of a child who is legally deprived of the opportunity to fully defend their rights in court. In this context, the authors put forward proposals to reform the current legislation in the study area in order to increase guarantees, ensure children's rights and legitimate interests, and minimize the possibility of abuse of parental rights.
