Eviction of citizens from residential premises occupied under a social rental agreement without providing other housing: features and legal problems

This article discusses one of the basic personal rights of a citizen guaranteed by the Constitution of the Russian Federation - the right to housing. The article raises the urgency of the issue of eviction of citizens from residential premises occupied by them under social rental agreements without providing other comfortable housing. The main legal features of the regulation of the institution of eviction are considered, namely: the grounds, the range of subjects entitled to demand the eviction of citizens, the procedure and consequences of the eviction of the employer and his family members living together with him from the residential premises without providing other housing. The article analyzes the norms of housing and constitutional legislation, as well as the views of scientists on this issue. The problem of inconsistency of the norms of housing law with the constitutional provision guaranteeing every citizen his personal right to housing and the impossibility of arbitrary deprivation of his housing is raised. The ways of solving the indicated problem are proposed.
