Interaction of the court and the prosecutor’s office on issues of ensuring the safety of business activities

Introduction: The market economy involves the formation of businesses of various forms of ownership, which leads to the development of activities such as entrepreneurship. Entrepreneurship, as an independent activity that meets the needs of the country's population for goods and services, requires constant protection from negative external influences. The state accentuates such issues as freedom of entrepreneurship, its expansion, and improvement of measures for protection of rights of entrepreneurs. The article deals with issues related to ensuring security in the sphere of entrepreneurship. The involvement of courts and prosecutor's offices in such matters has a direct impact on the development of entrepreneurial activity and, as a consequence, on the economic development of the country. The author draws attention to certain issues of activity of courts and prosecutor's office and parties of their interaction aimed at protection of entrepreneurship. Materials and Methods: the normative basis of the study is formed by administrative legislation; the methodological basis of the study was the private - scientific methods of cognition: formal - legal, comparative - legal, system analysis, and others. The Results of the Study: it has been possible to identify the main areas for effective cooperation between courts and prosecutors with a view to developing and applying measures to protect small and medium - sized enterprises. Findings and Conclusions: as a result of the study on the joint activities of courts and prosecutors' offices, an exchange of information should be organised in order to improve legislation in a timely and qualitative manner; special attention should be paid to the involvement of prosecutors in arbitration proceedings, as well as in courts of general jurisdiction in business cases.
