Opinion of the plenum of Supreme Court of the Russian Federation about the regulation of the procedure at the court of appellate jurisdiction

The article analyzes the position of the Plenum of Supreme Court of the Russian Federation on the issues of application of procedure criminal rules concerning the appeal of judicial decisions which have not yet inure. The positive and negative sides of apprehension of legislative instructions by the superior judicial body are revealed; the attention to contradiction of some interpretations of text of the procedural criminal law and discrepancy with the previously stated position is paid.
