Marriage and the purpose of creating a family: a discrepancy between the alleged

The author examines the content and legal format of the purpose of creating a family during marriage, analyzes the norms of family law and substantiates the conclusion about the artificially created concept of fictitious marriage as an institution of family law. The creation of a family is a goal in marriage, however, the objective absence of criteria to establish the presence or absence of such a goal leads to a violation of the private interests of persons entering into marriage. Violation of the rules of migration and other legislation when entering into a marriage constitutes the sphere of protection and protection of public interests and should not be correlated with the fictitious marriage.
