Conclusion of fixed-term employment contracts with pedagogical employees of the professorial teaching personnel in the context of employment legal relationship precarity issue

The article is devoted to theoretical and practical issues arising when concluding fixed-term employment contracts with pedagogical employees related to professorial teaching personnel. Using statistical analysis and systemic interpretation methods, the following legal issues were identified: related to the development of formalized criteria for concluding an employment contract for a period of 3 to 5 years; related to the absence of an employer’s obligation to announce a competition for non-vacant teaching positions for those classified as part of the professorial teaching personnel; related to the vulnerable position of pedagogical employees who cannot, for valid reasons (maternity leave, child care leave, etc.), take part in the competition. A conclusion is made about the advisability of abolishing mandatory competitive procedures for the positions of assistant and teacher. Other directions for improving legal regulation in the mentioned area are proposed.
