Legislative construction of criminal law sanction for violation traffic rules

The article considers the question on the essence of additional punishment, stipulated in the sanction of article 264 of the Criminal Code of the Russian Federation, in the form of deprivation of the right to exploit a motor vehicle. Authors note, that the given kind of punishment is not stipulated in General part of the Criminal Code of the Russian Federation and appears in sanctions of parts 1 - 6 of article 264 of the Criminal Code of the Russian Federation as unconditional kind of punishment, regardless to the features describing the subject. The given circumstances, according to authors, specify discrepancy of the punishment under consideration to attributes of criminal punishment.
