Legislative and law enforcement challenges of extradition in the criminal process

Introduction: the article considers the main legislative and law enforcement problems of extradition in the modern criminal process of Russia. The relevance of this study lies in the need to strengthen international cooperation in criminal justice, especially in the organization of the search, detention and transfer of persons who have fled from criminal prosecution on the territory of foreign states. The need for a thorough analysis of the regulatory framework and law enforcement practice of such cooperation reflects the need of modern society to strengthen the rule of law and the rule of law. Materials and Methods: in the course of the study, the current regulations and scientific publications on the topic under consideration were used. In the course of the analysis of the research materials, general scientific and private scientific methods of cognition of state-legal reality were used, reflecting the content of the legal institutions considered. Results: as a result of the study, the normative provisions and law enforcement practice of the Institute of extradition at the current stage of the development of the domestic criminal process were analyzed. The problems of certain aspects of the extradition of persons for criminal prosecution are raised, and the relationship of the legal norms of the institute of extradition with other institutions of criminal procedure law is also demonstrated. Discussion and Conclusions: relevant conclusions were formulated on the need for further improvement of the legal regulation of extradition in criminal proceedings, as well as amendments to the current criminal procedure law were proposed to eliminate some legal gaps in the field of law enforcement activities under consideration.
