The article discusses the problems associated with the protection of property rights of the state and the legal status of the prosecutor in litigation proceedings in cases involving the state. The author proposes to reconsider the procedural status of the prosecutor if he initiates legal proceedings in defense of the interests of Russia, its constituent entities and municipalities, notes that the private law nature of the dispute with the participation of the state allows the case to be transferred to an arbitration court, but the mandatory participation of the prosecutor in the process is necessary.
