The article is devoted to urgent questions of transfer to an «effective contract» of state and municipal general education organizations. The author analyzes the organizational aspects of changes in legal relationship between the employer and the teaching employee, as well as perspectivity of new terms of payment. In 2012, the Government of the Russian Federation developed a Program of stage improvement of wage system in state and municipal institutions. One of the goals of the Program was an idea of improvement of employee wage system, which was focused on achievement of definable benchmarks of quality and quantity of state (municipal) services (performance of work). The author comes to the conclusion that there are unresolved organizational problems, uncertainties in labor legislation, which can lead to violation of the rights of teaching employees of state and municipal general education organizations.
