The article is devoted to topical issues of the application of compulsory medical measures. The author examines the problems associated with the gaps in the legislative regulation of the application of compulsory medical measures before the adoption of an appropriate court decision. It is concluded that the current legal regulation of the application of compulsory medical measures in the Russian Federation is imperfect. It is noted that the following important issues have not been settled by the Russian legislator: 1) where and for how long before the adoption of the relevant court decision should the person be located in respect of whom the issue of applying compulsory medical measures is being decided; 2) what measures can be taken by a psychiatrist if a court decision on the application of compulsory medical measures has not yet been adopted / has not entered into force, and the patient already at this stage needs to undergo psychiatric treatment.
