Currently, the Criminal Procedure Code of the Russian Federation provides a clear structure of bodies authorized to conduct preliminary investigations, but it is very interesting and not ambiguous to determine the place in the system of preliminary investigation bodies of officials specified in part 3 of Article 40 of the Code of Criminal Procedure of the Russian Federation - captains of sea and river vessels on long voyages. The problem of law enforcement, at present, is that the criminal procedural status of officials specified in part 3 of Article 40 of the Code of Criminal Procedure of the Russian Federation is not defined. And there is also a need to develop theoretical provisions for practicing officials specified in part 3 of Article 40 of the Code of Criminal Procedure of the Russian Federation, and specifically for captains of sea and river vessels.
