Control Defects Administrative and Jurisdictional Powers of Rospatent

The article provides a comprehensive analysis of regulatory defects in the administrative and jurisdictional powers of the Federal Service for Intellectual Property (Rospatent). Key problems arising in the implementation of administrative procedures are considered, gaps and contradictions in the regulatory legal acts regulating the activities of Rospatent are revealed. Examples from judicial practice are given, a comparative analysis is carried out with foreign systems for protecting intellectual rights. The article discusses issues that have not previously been reflected in the scientifi c literature, namely, problems and defects in the legal regulation of the administrative and jurisdictional activities of Rospatent. Based on the study, proposals for its improvement are formulated, the implementation of which will significantly increase the effectiveness of protecting intellectual property rights in Russia.
