Active repentance as a part of pretrial cooperation between the accused and the investigative authority

The article examines the objective of the pretrial agreement on cooperation with the investigating body. Certain circumstances, which may be included in an agreement, compared with the composition of active repentance, as well as giving oneself up. Explains the differences and similarities between the institution of active repentance and circumstances of the mitigating liability, which may form the subject of pre-trial parties' agreement on cooperation.
