The study identifies the role of an easement agreement in managing conflicts of interest. Nowadays, if there is an objective need for an easement, it is easier to get a legal confirmation rather than conclude an appropriate agreement. However, doctrinal studies that help improve the agreement-based easement relationship should lead to the demand for easement agreements by the parties to property relations. This fact eliminates de facto confrontation between the possible easement holder and the grantor of the easement’s land. The easement agreements are the basis for the real relationship. Besides, they serve as a legal mechanism for keeping a balance of interests of property non-owners involved in the real relationship and manage the conflicts of interest of the owner and third parties.
