The dual nature of the institution of termination of citizenship of the Russian Federation

The article considers the institution of termination of citizenship of the Russian Federation. A comparative analysis of international law, national and domestic legislation regarding the loss of a citizen’s legal connection with the state is carried out. The hypothesis of the study lies in the dual nature of the institution of termination of citizenship, as a regulator of public order and national security, as well as as a manifestation of the sovereign right of the state to provide the opportunity to possess citizenship of the Russian Federation. The methodological basis of the research was general scientific and private scientific research methods: analysis, synthesis, induction and deduction, as well as the formal legal method. As a result of the study, it was determined that the termination of citizenship contains two types of relations: on the initiative of a citizen and on the initiative of the state. It is established that the provisions of international law allow for various forms of termination of a citizen’s legal connection with the State. The author concludes that the institution of termination of citizenship of the Russian Federation restores the status of a foreign citizen only in relation to individuals who violate Russian legislation. The Institute allows regulating migration processes and reducing social criminalization. On the other hand, the denaturalization process maintains the high status of citizenship of the Russian Federation, and also reserves the right for the state to influence the attitude towards citizenship of a certain person.
